Terms and Conditions
This document sets forth the legal terms and conditions (“Terms and Conditions”) for access to and use of the TraderZone website (“site”). By accessing this website and downloading, viewing and experiencing content therein, and in consideration of being allowed to do so by The TraderZone Corporation (“TraderZone”), a company incorporated under the laws of the Province of Alberta in the Country of Canada, which wholly owns and operates this website, you, the “Purchaser”, agree to the following terms of use and to entering into a limited license agreement and to entering into a legal contract with TraderZone. If you do not accept this limited license agreement and the terms of this legal contract, you may not access this website.

Access to Service
At the point of activation of the TraderZone website, the Purchaser is being granted an “access code or password” that allows you to use and fully access the site. You understand that the term of the access code(s) or password(s) shall be in effect for perpetuity, unless otherwise terminated under these Terms and Conditions, or by the terms of the Purchase Agreement and/or any applicable warranty periods.

TraderZone extends to Purchaser the right to receive a full refund of the purchase price during the Warranty Period. The Warranty Period commences on the date of purchase and ends on the 21st day from the date of purchase order. To obtain your refund, contact TraderZone in writing prior to the last day of the Warranty Period. Refunds are processed by TraderZone at the end of each month.

You acknowledge and agree that this website may be used only for lawful purposes by persons seeking information. You agree to restrict your use to such lawful purposes.

Use of the TraderZone real time services are limited to the individual and personal use of the Purchaser and shall not be used for commercial purposes. Information obtained from the TraderZone site may not be re-sold by the Purchaser nor posted or distributed in any public forum including, but not limited to, print, the Internet, any form of newsletter, radio or television, or any other person(s) by Purchaser.

You acknowledge that the Internet and websites accessed by you are inherently dangerous and subject to computer, system and network failure as well as malicious human activity. While TraderZone will take such steps as are reasonable in the circumstances to maintain the security of this website and your privacy with respect to information you provide, you agree that you use this website completely at your own risk and that in no event shall TraderZone be held liable for any loss or damages, however caused, except as expressly provided in this agreement. You acknowledge that much of the information on this website provided by third parties is outside the control of TraderZone. You agree that you assume all risk and full responsibility for appropriate use of the information provided. You agree that TraderZone has no control over other websites linked to from this website and that TraderZone cannot be held responsible for the currency or validity of links nor the content or performance of such other websites. TraderZone assumes no responsibility with respect to the linked website, or for any potential damage arising out of or in connection with the use of any such link. In addition, the existence of a link between this site and any other website is not and shall not be understood to be an endorsement by TraderZone of the owner or proprietor of such linked websites.

Purchaser acknowledges that the TraderZone has made no representations, warranties or guarantees other than those expressed herein. Purchaser has not relied upon, and TraderZone specifically disclaims, any other representations or warranties.

Purchaser acknowledges that individual performance depends upon individual skills, time availability and dedication of each Purchaser. The data is provided “as is”. Purchaser further acknowledges that TraderZone or any third party shall not be liable to you or any third party for any loss or damage, direct, indirect or consequential, arising from (i) any inaccuracy or incompleteness in, or delays, interruptions, errors or omissions in the delivery of the data or any other information supplied to you through this product or (ii) any decision made or action taken by you or any third party in reliance upon the data. Purchaser further acknowledges that TraderZone or any third party shall not be liable for loss of revenues or any punitive indirect, consequential, special or similar damages whatsoever, whether in contract, tort, or otherwise, even if advised of the possibility of such damages incurred by you or any third party.

Liability
Where the information consists of pricing or performance data, the data contained therein has been obtained by WWQuote from various data providers, (collectively, the Service Providers) through sources believed to be reliable.. Data computations are not guaranteed by any information service providers, third party or TraderZone or any affiliates and may not be complete. Neither any information service providers, third party or TraderZone give any warranties, as to accuracy, adequacy, quality or fitness, timeless, non-infringement, title, of any information for a particular purpose or use in all such warranties are expressly excluded to fullest extent that such warranties may be excluded by law. You bear all risk from any use of results of using any information. You are responsible for validating the integrity of any information received over the Internet. Transmission for information over the Internet may be subject to arbitrary delay beyond our control, which may delay the provision of our services and the execution of your orders. You acknowledge that neither any information service providers, third party nor TraderZone will be liable to you or any third party for any losses arising from such delay. In no event will any information provider, third party or TraderZone, be liable for any consequential loss including but not limited to special, incidental, direct or indirect damages, resulting from delay or loss of use of our Internet services. Purchaser agrees that neither TraderZone or any third party, nor any agent, subsidiary or representative thereof, shall have any liability, contingent or otherwise, for the truthfulness, accuracy or timeliness of any information obtained from the site or for any decision made or taken by the Purchaser in reliance upon any information obtained from the site.

Damages
TraderZone is not responsible for any damage to your computer, software, modem, or other property resulting from your use of the site. TraderZone reserves the right to refuse any request for purchase of our services and or product(s).

Purchaser agrees that any and all damages resulting from the use of this site, whether or not TraderZone shall have been advised of the possibility of such damages, shall in all cases be limited to payment of the sum of $10.00 in Canadian funds. Purchaser further acknowledges and agrees that TraderZone or any third party providing information on the site shall not be liable for any loss resulting from a cause over which TraderZone or the third party does not have direct or indirect control including, but not limited to, failure or incompatibility of electronic or mechanical equipment, software, communication lines, telephone or other communication system interconnect problems, unauthorized access, theft, operator errors, severe weather, earthquakes, strikes and other labour problems.

The “TraderZone word mark” and “TraderZone design logo”, as well as other trade names under which TraderZone does business are trade names and trademarks of TraderZone. In addition, the names, trade names and/or trademarks of third parties, including clients of TraderZone, are similarly protected. Any unauthorized use of such trademarks is strictly prohibited absent the prior written consent of TraderZone and/or the relevant third party.

TraderZone grants to you a non-exclusive, limited and revocable license to download, view, listen to and experience the content of this web site to and via your computer for your own personal and non-commercial use. “Content” in this license agreement includes images, text, logos, graphics, information, software, computer code and applications, animations, video and any and all types of multimedia. You do not own the Content. All right, title and interest, including but not limited to Copyright and Trademark, in and to this website and all content accessed or presented by it, shall remain with and be the exclusive property of TraderZone or its licensors or other owners of such content.

You may not assign this license agreement. It is and shall remain personal to you.

As a matter of policy, TraderZone does not consider suggestions or ideas that are offered to us on an unsolicited basis.

This license and terms of use contract, together with our Privacy Statement sets forth the entire agreement, contract and understanding between you and TraderZone.

This license and terms of use contract shall in all respects be governed by the laws of the Province of Alberta, Canada and the laws of Canada in effect in the said Province at the time. You agree that any and all disputes will be adjudicated only by the Court of Queen’s Bench of Alberta, or its successor. You expressly submit to and attorn to the jurisdiction of said Court, and you undertake and agree to bring no complaint and file no action in any other Court whatsoever.

Should any portion or portions of this license and terms of use be held by a Court of competent jurisdiction to be unenforceable, then such portion or portions shall be severed from this license and terms of use, and the remaining portions thereof shall be enforced. This agreement shall enure to the benefit of the heirs, executors, administrators and assigns of The TraderZone Corporation.
